Department of Labor sues coffee kiosk company for FLSA violations

Seattle-based Baristas Coffee Company is being sued by the U.S. Department of Labor over its time and attendance compensation practices, which allegedly violate federal laws.

According to a Department of Labor news release, "employees were sometimes paid with checks that were unsigned or had insufficient funds, which resulted in workers being paid less than the federal minimum wage for all hours worked. In addition, employees were not paid proper overtime wages."

Investigators also found violations of the Fair Labor Standards Act's record-keeping provisions.

Specifically, the department is seeking an unspecified amount of back wages and damages for 45 of the company's employees dating back to August 2009, as well as an additional $42,000 for FLSA violations.

KIRO-TV reports that the Washington State Department of Labor & Industries launched a separate investigation into 16 complaints related to Baristas' employee attendance compensation earlier this year. The department ordered Baristas owner Barry Henthorn to pay back wages and fines, $2,200 of which he still owes.
