Dairy delivery drivers file FLSA lawsuit

Three delivery drivers, one current and two former, are suing a dairy in Maine for time and attendance violations related to unpaid overtime. According to the Portland Press Herald, the plaintiffs, claiming a violation of Maine Labor Laws and the Fair Labor Standards Act, filed a class-action lawsuit at the U.S. District Court in Portland.

The individuals stated that the practice of not paying drivers for overtime has been going on for years at the dairy. In the lawsuit, the plaintiffs stated that they would routinely work between 50 and 60 hours per week on their routes, but would only be paid a flat rate.

"It's currently that way, and it's been that way for a long period of time," an attorney for the plaintiffs told the Portland Press Herald.

According to the FLSA, as long as an employee is not classified under exempt status, overtime must be paid for all work-related activities above 40 hours in a week. In their lawsuit, which could affect as many as 50 employees currently working as drivers at the dairy, the plaintiffs are requesting the company pay them all overtime owed with interest, as well as other damages.
